First of all, we need to respond to "what is the Delivery Period" as far as INCOTERMS is concern.

The LD can be imposed as the goods were not delivered as per LOA.

Dear Colleagues,

It has been almost 5 years since I posted the article below. It is very unfortunately, it didn't get the deserved attention in terms of contributions form the forum members. Due its importance in the procurement goods especially those imported and disputes in relation to interpretation of INCOTERMS. Over the past five years, I have evidenced most of the institutions specifying CIF, CIP and DDP in their bidding documents without adequately understanding the obligations/responsibilities of the parties to the contract and what real meaning of "Delivery Period" in relation to those terms. I am believe it is high time now we discuss this to the fullest for the benefit of others.

1. What are the obligations/responsibilities of the parties in relation those terms?
2. What is the Delivery Period in relation to those terms?

We had specified in our bid documents that the delivery period should be 12 weeks CIF Port of destination [Dar es Salaam] from the date of issued of letter of acceptance. One particular bidder was awarded on the CIF INCOTERMS however, after the 12 weeks the goods did not arrive at the port of destination.

Upon imposition of liquidated damages for delayed delivery, the Supplier claimed that as per the INCOTERMS guidelines, the Seller Obligation is to deliver the goods on board the vessel at the Port of Shipment on the agreed date. Therefore, the Shipped on Board date of the Bill of Lading is to be used as the date of delivery in a contract concluded according to INCOTERMS. We are of the opinion that the Supplier committed to deliver the goods within 12 weeks to the port of destination from the date of letter of award.

Can we consider that the LD on late delivery can be applied as the Supplier failed to delivery as initially agreed, i.e ensure that the goods are delivered to the port of destination within 12 weeks. What is your take on this?
