Mauka, I think term “responsible bidder” could be new to practitioners but it is well covered in our legislation. In fact this is a result of post-qualification [Due Diligence] process adequately provided in R94/97/2005.
In simple words “Responsible bidder” is the lowest evaluated substantially responsive bidder who has capacity and capability to execute the contract. This is assessed using criteria stipulated in R14/97/2005 [Qualification of Suppliers, Contractors, Services Providers or Asset Buyers], R94(2)/97/2005 and Qualification Information provided in the Bidding Documents. The bottom line is that qualification criteria provided in the Bid Documents are normally used to establish “responsible bidder”.
“Responsive bidder” is the bidder whose bid has conform to all the terms, conditions and specifications of the tender documents without material deviation or reservation [R90(7)/97/2005]. This is a result of Preliminary Examination of Bids.

Dear forum members
There has been a bit of confusion amongst the non- procurement and procurement professionals that the term “responsible bidder” and “responsive bidder” are often used interchangeably while they are quite different term with different meaning attached and hence distort the intended meaning.
Then, I saw this to be important to share with other forum members in order to eliminate the above confusion.
Are these terms mean the same things?
