PPAA Review the PPRA’s Decision Arising from Blacklisting of Tenderers – PPA 2011
Section 88(6) of the new Public Procurement Act of 2011 empowers the Public Procurement Appeal Authority (PPAA) to review the Authority’s (PPRA’s) decision arising from blacklisting of tenderers.
i.I am wondering how this will work for the cases relating to Fraud/Corruption, Non-performance and Termination. Are these cases appealable?
ii.Will PPAA’s review on blacklisting be limited to tendering process cases or will be extended to the cases arising out contract execution? To me the term “tenderer” cease when parties to the contract signed the contract thereafter terms and conditions governing the contract take over.
I do hope new regulations will tell us more on this.
