Why are we amending procurement plan?
Could be; adding new requirements, changing method of procurement (selection process), prevailing market rates (cost estimates) has changed, milestones in the plan are no longer realistic etc. It should be noted that the referred amendments are being made in the existing plan which is like preparing an addendum to the existing contract – if we amend the contract, are we preparing a new contract or make changes in the exist contract? Oxford defines the word “update” as “to make something modern by adding new parts/information.
From the legal point of view, PPA 2011 and it attendant Regulations 2013 recognize that procurement plan is a living document or dynamic documents which should continually updated or edited. This fact can be attested in the following provisions in the Regulations 2013;
1. R 69 (6)/2013 – The procuring entity shall prepare its estimates based on prevailing market prices as provided by the Authority and updated from time to time;
2. R 69 (9)/2013 – Approval of the accounting officer shall be obtained either by inclusion of that procurement in a procurement plan or request as an individual item of procurement when not included in the procurement plan.

Does a procurement plan update create a new procurement plan?
In a recent conversation with a colleague, the issue of updating procurement plans was raised. His impression was that when updating a procurement plan, a new and different procurement plan is created; as result, a second procurement plan is created rather than an update of the earlier version of the procurement plan. As an example: the first version is Procurement Plan #1 and the update is Procurement Plan #2. What are your thoughts on this? Is the updated procurement plan an amended version of the existing procurement plan or is it a new and entirely different and separate procurement plan altogether?
