Thanksme,

Indeed. Justification of effective competition in procurement is a challenge. It requires knowledge or strategy in detecting bid rigging. However, there are some indicators which can assist you in detecting if there is lack of competition such as suspicious pricing patterns (e.g. the difference of prices among bidders very marginal) similarities in documents submitted, suspicious s behavior by firms etc.

with regard to section 59 (3), in tendering process how can I justify that there is lack of effective competition; S.59(2)(a).
